Ces réglementations mettent en place des systèmes de régulation bancaire relativement proches. Dans un cas comme dans l'autre, la responsabilité de l'application de la loi est donnée à un organe para-étatique indépendant sous la forme d'une commission bancaire. Ce projet a pour objectif d'effectuer une étude comparative approfondie de la naissance, du développement des ces Commissions bancaires suisses et belges entre 1935 et 1980.  Il s'agira dans un premier temps de comprendre dans quel contexte économique, politique et social ces institutions ont été créées et d'interroger le rôle que les différents acteurs – étatiques comme privés – ont joué dans leur constitution. Dans un deuxième temps, le développement et les activités concrètes des régulateurs durant près d'un demi-siècle, ainsi que des législations qui leur servent de cadre, seront analysés. Dans ce cadre, l'une des questions principales à laquelle ce travail tentera de répondre sera de savoir quels moyens d'action ont été mis à disposition des instances de régulation. Autrement dit, d'interroger l'équilibre de pouvoir entre acteurs publics et privés dans le domaine de la surveillance bancaire.

This dissertation discusses the evolution of banking supervision regimes in Switzerland and Belgium, from the establishment of the first banking laws in the 1930s to the turning point of globalisation and deregulation in the late 1970s. During this period, both countries set up banking regulations in the aftermath of the Great Depression. Interestingly, both the Swiss (in 1934) and Belgian (in 1935) authorities chose to create a new supervisory body to deal with banking supervision, instead of putting the central banks or the finance ministry in charge of supervising the commercial banks. The Eidgenössische Bankenkommission in Bern and the Commission bancaire in Brussels were established to enforce the liberal regulations provided in the respective banking legislations. In the post-Second World War period, both commissions experienced an extension of their supervisory scope, in the wake of the increasing internationalisation of banking and the financial innovations related to it. In parallel with this regulatory evolution, the same period is marked by an outstanding growth of the Swiss financial centre, whereas the Belgian banks showed less vigorous growth rates. One of the issues that this project addresses is the question of the influence of the regulatory framework on the development of financial centres. Moreover, in using a broad spectrum of unpublished archival documents, the purpose of this study is to analyse the reasons for the setting up or the modification of a supervisory regime. Once established, the issue of the means of action available to the supervisory authorities is also essential: What information did the state authorities rely on? How did they enforce the law? In other words, the balance of power between public and private actors in the field of banking policy will be examined in this project. It is noteworthy to underline that the issue of financial regulation - although highly topical - is still relatively unknown in economic historiography.
