Foreign nationals in closed prisons

Criminally sentenced foreign nationals are at risk of being doubly excluded from society. They are incarcerated in closed prisons, and in addition, penal law and immigration law allow their deportation and thus total exclusion from Switzerland.

Background
In the 1990s the percentage of foreign nationals in Swiss prisons increased by 40 percent. With 70 percent, the rate of foreign nationals in the closed penitentiary system is disproportional. This development raises a number of questions: What are the causes of the growing proportion of foreign nationals in closed prisons? What impacts does this have on the actors involved (inmates, prison employees, decision-makers in administration and politics)? There is a lack of social scientific research on these issues.

Aim and method
The project is examining these issues taking an interdisciplinary approach, from the perspectives of four groups of affected persons: foreign national prison inmates, prison employees and cantonal authorities in the Cantonal Department of Prison Administration and Cantonal Migration Offices. The project will investigate the closed prisons of Thorberg (for men) and Hindelbank (for women). The data will be collected by means of interviews with foreign national inmates, prison staff and the two cantonal authorities; participative observation in the prisons; quantitative and qualitative evaluation of prisoners’ records of the last ten years; analysis of data on sentencing from the Federal Statistical Office (from 1983 on); juristic analyses. This procedure yields a diachronic view of the developments of the past decades.

Significance
Prisons are not only sealed off and protected from the inside to the outside; access from the outside to the inside is also well guarded. It is important to take these circumstances into account. The project will give the wider public insight into the sensitive area of criminal sentence execution and into the situation of foreign nationals in particular. The project will deliver fundamental social scientific findings on the execution of criminal sentencing in Switzerland and thus supply a basis for further research. The results will contribute to scientific discussion on the „ethnology of prisons“ and will be provided to decision-makers in the area of criminal sentencing as a resource for coping with the new realities of immigration and globalization.
