Contenu et objectifs du travail de recherche

Tout d’abord, la recherche entend procéder à une analyse juridique du concept d’intégration tel qu’il est proposé dans la loi (LEtr et LN) et tel que ce concept est interprété et concrétisé dans la jurisprudence des tribunaux et la pratique des autorités administratives (cantonales et fédérales).

Dans un deuxième temps, dans une perspective psychologique et socio-juridique, la recherche proposera une série d’étude de cas de parcours de vie de personnes migrantes. Il s’agira d’abord de reconstruire ces trajectoires dans le but de comprendre et de montrer comment les lois et leurs applications les influencent ou les modèlent. Ensuite, une analyse inspirée de la « clinical law » se focalisera sur des « points de rencontre » spécifiques que les migrants ont avec le système administratif et judiciaire suisse. Globalement, l’analyse critique de cas, conflictuels ou non d’un point de vue juridique, visera à « reconstruire » les différentes étapes qui concernent la participation plus ou moins active des personnes migrantes, en tant que « protagonistes » ou « acteurs » de leurs propres cas.

Contexte scientifique et social du projet de recherche

La dimension interdisciplinaire (droit, sciences humaines et sociales) à la base du projet pourra apporter un éclairage nouveau aux parcours d’intégration dans le contexte socio-juridique suisse, en proposant, en même temps, une perspective de recherche innovante qu’on peut qualifier de « law and humanities for migration studies».

Abstract

The proposed research aims to analyze the notion of integration, from the one side, as it is used in the Swiss law and in its applications, and on the other side, in terms of its implication in the actual life trajectories of migrants in Switzerland. First, it will provide an analysis of the concept of integration as set out in Swiss law - in particular, the Federal Act on Foreigners (LEtr) and Law on Citizenship (LN) - as well as their proposed revisions, and how these are interpreted and contained in the jurisprudence of the courts and practices of the administrative authorities. Second, it will examine the lifecourses of immigrants in Switzerland, and examine how these laws and their applications shape integration trajectories. Third, the project will focus on specific encounters between these migrants with the legal system, and through legal case analysis, examine the diverse perspective on the process of integration. The proposed study has thus two main research lines, which are complementary and interdisciplinary. The first research line, which is based on the legal aspect, will carry out a systematic study of the concept of integration as set out by the law - with the various federal (and cantonal) laws (which in principle pursue different purposes) - as well as the applications and interpretations of this notion, a priori rather vague and artificial, that are the result of application by the administrative authorities (for most cantons) and, on appeal, by the courts (district courts and the Federal Court). This first research line will be essentially based, from a methodological point of view, on traditional legal analysis methods (study and analysis of legal texts [laws, ordinances, explanatory messages] modes of legal interpretation and case studies through the analysis of administrative and judicial rulings). The second research line is developed from a socio-psychological perspective, and is methodologically based on case studies. It aims at documenting trajectories of migrants, and especially their exposure to the integration “duties” explicitly formulated in formal laws in implicitly carried out in the practices of the administrative authorities (e.g. police, school authorities, etc.) and in daily exchanges. The two lines will coincide in the elaboration and close analysis of specific legal cases of which these migrants are the main protagonists. The combination of these research lines will provide a new interdisciplinary and exploratory approach of “law and humanities for migration studies”.
